FACTS. - Jack Daniels was partner in Park Avenue, which owned a condo project to which Deseret Federal made a construction
loan. Park Avenue contracted with Daniels to build the condos; he did so, and was paid. However, when the condos were sold,
Park did not pay Daniels his share of the profits. Other partners in Park Avenue induced Daniels not to file notice of mechanic's
lien so that they could obtain refinancing, and promised payment in two weeks. He repaired some frozen pipes. Still unpaid,
he filed notice of lien. PROCEEDINGS. - Daniels sued to foreclose his lien. The district court granted summary judgment in favor of Deseret, and Daniels
appealed.
